Jan 6 Committee Faces Unprecedented Choice Of Whether To Call Republican Lawmakers To Testify

Capitol Riot, chair of the House Special Committee of Inquiry on Jan. 6, 2021, told reporters Wednesday that they reissued a subpoena for Representative Moe Brooks (R-Alabad) after they failed to file the original subpoena. .

"I've rewrote his summons. You know we can't serve him - he's the only member we can't serve. So either we go back to him or he's gone," said President Benny Thompson.

Thompson explained that the subpoenas took some time before being reissued, and that those trying to serve Brooks "couldn't find him. He wasn't there, he was fighting, running for Senate."

On Wednesday, Brooks said he was willing to testify, but only in cases related to January 6th, according to CNN. He added that he would like to see in advance that he could be questioned about any documents.

"My main demand is to be public so the public can see it — so they don't take bits of it," Brooks said, according to the network.

Previously, Brooks had also set a number of requirements that he must meet certain conditions to testify before a committee, including that only lawmakers on the committee must question him and that this must be disclosed.

"I don't want this witch-hunt committee and [President] Nancy Pelosi [California] trying to interfere in the Republican primary in the US Senate in Alabama," Brooks told Fox News last Sunday.

Round two of that race took place on Tuesday and Brooks lost to Katie Brett.

When asked if the committee would agree to Brooks' terms, Thompson replied, "He didn't tell us."

"We will take action against anything that comes our way," he later added.

This isn't the first time officials have had trouble finding Brooks for their service. In a separate case, Congressman Eric Soilwell (California)'s legal team sued Brooks last June over the Capitol riots after months of trying to locate him, Axios said.
